Affiliate Program Terms
These terms govern participation in the Fitsylvania affiliate program, including approvals, referral attribution, commission-basis rules, self-referral restrictions, payout requests, fraud controls, and program moderation.
Operated by FITORA LTD, registered in England and Wales. Registered office: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ
1. Joining and Approval
- Fitsylvania may make an affiliate program available to approved client and trainer accounts. Applying does not guarantee approval.
- We may request information about your audience, traffic sources, distribution methods, brand use, and promotional plans before approving or restoring an affiliate account.
- Fitsylvania may approve, reject, suspend, restore, or permanently end participation where reasonably necessary for legal compliance, fraud prevention, brand safety, quality control, or platform integrity.
- Participation is personal to the approved account and must not be sold, assigned, or sublicensed without Fitsylvania's express written consent.
2. Eligible Referrals and Attribution
- Fitsylvania may issue one universal referral link per approved affiliate profile and use that link to attribute qualifying signups.
- A referred user may become eligible for affiliate credit when they create a qualifying account through an approved attribution path and later complete qualifying on-platform activity as a client, trainer, or both.
- If a referred user later becomes an approved trainer, Fitsylvania may treat trainer-side qualifying activity as part of the same referral relationship rather than requiring a separate second link.
- Fitsylvania may set attribution windows, click-tracking windows, referral limits, campaign rules, and qualification rules globally or per affiliate profile.
- Fitsylvania's tracking, fraud, and reconciliation records are the source of truth for determining whether a referral is attributable and eligible.
3. Commission Basis - When Commissions Apply
Affiliate commissions are calculated only on transactions that actually carried a platform fee. The applicable rules are:
- First marketplace-sourced transaction earns commission. When a referred client engages a trainer for the first time through Fitsylvania marketplace discovery (search, browse, recommendations, or affiliate referral), Fitsylvania charges a platform fee on that transaction. Affiliate commission is calculated from that platform fee.
- Repeat transactions and direct-link transactions earn no commission. Subsequent transactions between the same client and trainer carry no platform fee, and so generate no affiliate commission. The same applies to session bookings or coaching subscriptions originating from a trainer's direct profile link rather than from marketplace discovery. Courses are the exception: a course always carries the platform fee, so an eligible course sale can generate affiliate commission regardless of how the client reached it.
- Commission formula. Affiliate commission is ten per cent (10%) of the platform fee Fitsylvania charges on the underlying transaction (i.e. 10% × platform fee). Where no platform fee applies to a transaction, no affiliate commission is created. Fitsylvania may change the affiliate share percentage at any time with effect for future activity.
- Refunds and reversals. Where the underlying transaction is refunded, charged back, or otherwise reversed, the affiliate commission accrued on that transaction is reversed by an offsetting adjustment.
- No fee taken means no commission basis. If a transaction has zero platform fee due to waiver, promotion, or adjustment, no affiliate commission is created for that transaction.
4. Self-Referral - Trainers Cannot Earn on Their Own Clients
To prevent abuse of the affiliate program, the following self-referral restrictions apply and are enforced automatically by the Fitsylvania platform:
- Trainers earning on their own bookings is prohibited. If a trainer holds an affiliate profile and refers a client who later books with that same trainer, no affiliate commission is created for the trainer - even if the booking qualifies as a marketplace transaction. The referral only generates earnings if the referred client transacts with a different trainer.
- Trainers earning on their own course sales is prohibited. If a trainer referred a client who then buys that trainer's own course or subscribes to that trainer's own coaching plan, no affiliate commission is created. Commission is only created when the referred client transacts with a different trainer's services.
- Self-signup is prohibited. You must not use your own affiliate link to create a second account or simulate a referral for yourself or an entity you control.
- Fitsylvania may block, void, reverse, or claw back any commission where self-referral is detected, regardless of timing.
5. Restricted Conduct
- You must not use spam, misleading ads, fake discounts, cookie stuffing, forced clicks, fake signups, automated traffic, cloned pages, fake reviews, impersonation, trademark abuse, or undisclosed paid promotion in breach of law or platform policy.
- Trainers and clients may participate in the affiliate program only in compliance with these terms and Fitsylvania's marketplace rules. Participation in one side of the marketplace does not entitle you to commission on your own transactions.
- You must not promote Fitsylvania in a way that makes misleading earnings claims, medical claims, safety guarantees, or performance promises that Fitsylvania has not authorised.
- Fitsylvania may block, void, or reverse any referral, commission, or payout that we reasonably believe results from restricted or fraudulent conduct.
6. Required Disclosures (FTC and Advertising Law)
If you promote Fitsylvania, you have a financial relationship with us, and advertising law in many countries (including the US Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials, 16 CFR Part 255, and similar UK/EU rules) requires you to disclose it.
- You must clearly and conspicuously disclose your material connection (for example, "I earn a commission from Fitsylvania" or "#ad" / "affiliate link") next to every endorsement, review, post, video, or link that uses your affiliate code, before the consumer engages with it. The disclosure must be hard to miss and in the same language as the promotion.
- Disclosures must not be hidden behind "more" links, buried in a block of hashtags, or placed only in a bio or profile.
- Your claims must be truthful and substantiated. Do not promise specific fitness, health, weight-loss, or earnings results, and do not present a paid promotion as an independent opinion you do not hold.
- Failure to disclose, or making deceptive claims, is grounds for immediate termination from the affiliate program and reversal of affected commissions, and may expose you to direct liability under advertising law.
7. Payout Requests, Tax, and Moderation
How payouts are processed:
- Affiliate payouts may be requested only through approved payout methods and are subject to admin review before approval or paid status.
- Fitsylvania uses Stripe to send affiliate payouts. To receive a payout you provide a bank account. Your full account details are sent securely to Stripe to set up the payout and are not stored by Fitsylvania, which keeps only the last four digits for your reference.
- Before funds are released, Stripe may require identity and bank-account verification. In some countries, including the United Kingdom, this includes a bank name-matching check (Confirmation of Payee). A payout cannot be sent until any required verification is complete.
- You choose a single currency for each payout. Where your balance includes commissions earned in other currencies, those amounts are converted into your chosen payout currency at the exchange rate Stripe provides when the payout is prepared. Exchange rates change and may include a currency-conversion margin, so the amount shown when you request a payout is an estimate and the final amount is set when the payout is sent.
- A payout processing fee may be deducted from each payout to cover the cost of sending the money to you, including any cross-border and currency-conversion fees. The net amount is what arrives in your account. Fitsylvania may change the fee structure with effect for future payouts.
- Payouts open once your available balance in the chosen currency reaches the published minimum for that currency. Minimum amounts may differ by currency and may change with effect for future requests.
- Payout arrival times vary by destination and bank. Domestic payouts may arrive the same or next business day, and international payouts typically take one to seven business days. These times are estimates, not guarantees, and may be longer where verification or compliance review is required.
- If a payout fails, is returned, or is cancelled, the amount is returned to your affiliate balance and the request may be retried. Repeated failures may require you to update your bank details.
Tax, records, and moderation:
- Fitsylvania may request identity, tax, compliance, or fraud-prevention information before releasing payout.
- You are responsible for taxes, reporting, and legal compliance arising from affiliate earnings unless mandatory law says otherwise.
- Fitsylvania may preserve affiliate records, traffic records, wallet records, payout requests, and moderation notes as reasonably necessary for audits, reconciliation, disputes, or legal obligations.
- Fitsylvania may reverse, offset, or withhold affiliate earnings connected to refunds, chargebacks, fraud, duplicate attribution, self-referral, abuse, ineligible traffic, policy violations, or reconciliation corrections. Reversals reduce your balance in the currency the commission was earned in and may be offset against current or future payouts.
- If you disagree with a moderation or payout decision, you may appeal through Fitsylvania support. Appeals do not guarantee reinstatement or payment.
8. Brand Use, Public Claims, and Program Changes
- You may not imply that you speak for Fitsylvania or that Fitsylvania endorses claims, pricing, or guarantees you create.
- You must not make misleading earnings claims, medical claims, safety claims, or platform guarantees in promotional materials.
- Fitsylvania may change, pause, or end the affiliate program, any campaign, any commission structure, or any affiliate feature at any time with effect for future activity.
- Questions about the affiliate program should be directed to [email protected].
